The undersigned dog owner (the “Owner”) understands that the participation by Owner’s and Owner’s dog(s) in the Pack Walk is not without some risk. Despite all of the participating dogs appearing healthy, being handled with reasonable care, and having been invited to attend the Pack Walk by Holiday Barn, dogs are not always predictable.
Owner acknowledges the risks and hereby releases, holds harmless, and waives any and all claims arising out of the Pack Walk that Owner has or may in the future have against Holiday Barn, its employees, owners, and/or agents for: (1) any loss, property damage, expense, or personal injury that Owner may suffer resulting from any conduct, including negligent conduct, of the employees, owners, and/or agents of the providers of the Transportation or the Destination, but not arising out of the negligent acts of Holiday Barn itself; and (2) any loss, property damage, expense, or injury to Owner’s dog(s) resulting from any conduct, including negligent conduct, of any other owner or any other dog, the employees, and/or owners, or Holiday Barn.
Owner agrees to hold Holiday Barn, its employees, owners and/or agents, harmless from any and all claims arising out of the Pack Walk asserted by or on behalf of any owner of any other dog which may be injured or damaged by reason of the action of Owner’s dog(s).
Owner further agrees to pay any veterinary/medical expenses incurred as a result of injury to Owner’s dog(s) or caused by Owner’s dog(s) to another dog, arising out of any confrontation or other action among dogs during the Pack Walk. Owner hereby gives Holiday Barn permission to seek veterinary care for Owner’s dog(s), at the Owner’s expense, by the veterinarian of Holiday Barn’s choice. Owner will not seek to hold Holiday Barn, its employees, owners and/or agents responsible for any injuries or damages which may result by reason of not seeking such veterinary care.
